Terms of Service

Effective September 1, 2026. This is a first-pass draft — have it reviewed by counsel, and fill in the bracketed items, before relying on it for a live launch.

1. What Fondra is

Fondra lets a host create an event, connect their own Google Drive, and share a QR code or link so guests can upload photos and video straight from their phone browser. Uploads are relayed by our backend into the host's Drive; we don't keep a copy. By using Fondra as a host or a guest, you agree to these terms.

2. Accounts

You need an account, via Google sign-in or our email-link sign-in, to create an event or to upload to one. You're responsible for activity on your account and for keeping your sign-in method secure. See our Privacy Policy for what account-level data we collect and how it's used.

3. Hosts

  • You control the event: its visibility setting, who can join, and when it closes.
  • Connecting Drive authorizes Fondra to create a folder in your Drive and write guest uploads into it, on your behalf, using the narrow drive.file permission scope, meaning we can only see and manage the files we create there, not the rest of your Drive.
  • As the data controller for your event's uploads, you're responsible for having a lawful basis to collect your guests' photos and video, and for telling guests what you intend to do with them (e.g. via the event description or your own house rules).
  • Only you can delete uploads to your event.

4. Guests

  • You must own the rights to what you upload, or have permission to share it.
  • Uploading grants the host a license to use, in the host's own Drive, what you upload to their event; that's the point of the product.
  • Don't upload anything illegal, or anything you don't have the right to share.

5. Party Points and payment

Your first event is free (up to 30 photos, 15 guests, photos only). Every event after that needs Party Points — a points balance you buy in any quantity and spend later, per event, at creation time. Points never expire and can be stockpiled indefinitely. Purchases are processed by Polar, our Merchant of Record, who handle billing and applicable tax. See our pricing page for current quantities, prices, and what each unlocks.

Party Points purchases are final and non-refundable through our normal purchase flow. Before every purchase, you actively confirm — via a separate, unticked-by-default checkbox at checkout, not this document alone — that you want access to begin immediately and that you understand you are giving up your EU statutory 14-day withdrawal right on that purchase by doing so, as permitted under EU consumer law for digital content/services once performance has begun with your express consent. We keep a real, timestamped record of that confirmation for every purchase. A refund issued at our own discretion outside this normal flow (for example, a manual correction for a billing error) remains possible, but is not something you can request as of right.

6. Moderation and enforcement

We may suspend an account or event that violates these terms, for example illegal content or abuse of the upload endpoint. Day-to-day moderation of what's appropriate for a given event is the host's responsibility, via the host's own delete controls.

Fondra is intended for normal use by a single host or organization running their own events. We reserve the right to review, and if necessary limit or suspend, accounts whose usage substantially exceeds normal patterns for genuine event photo-sharing, including use of the service for purposes other than sharing photos and video from real events.

7. Service availability

We aim for reliable uploads, including retrying on flaky connections, but Fondra is provided as-is without a guaranteed uptime commitment in this version of the terms.

8. Limitation of liability

To the fullest extent permitted by law, Fondra isn't liable for indirect, incidental, or consequential damages arising from use of the service, including loss of media that was never in our possession, since uploads are relayed directly into the host's own Drive.

9. Changes

We may update these terms as the product changes. Material changes will be reflected by updating the effective date above.

10. Governing law

These terms are governed by the laws of Poland, and any dispute not otherwise resolved is subject to the exclusive jurisdiction of the Polish courts. Fondra is operated by an individual as a sole proprietor, not a registered company — references to "we"/"our"/"Fondra" throughout these terms refer to that individual operator, trading as Fondra. [The operator's full legal name and registered business address are to be added here before this page is considered final — see the disclaimer above.]
